IMPORTANT NOTICE: THIS DOCUMENT CONTAINS IMPORTANT INFORMATION REGARDING YOUR RIGHTS AND OBLIGATIONS. BY PLACING AN ORDER OR USING OUR WEBSITE OR SERVICES, YOU CONFIRM THAT YOU ARE AT LEAST 18 YEARS OLD AND AGREE TO BE BOUND BY THESE TERMS. THESE TERMS INCLUDE A BINDING ARBITRATION AGREEMENT AND A CLASS ACTION WAIVER, WHICH MEANS DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS AND NOT BY A JURY TRIAL OR CLASS ACTION.
These Terms and Conditions (“Terms”) apply to the purchase and sale of products offered by Tuna Cans USA (“Tuna Cans USA,” “we,” “us,” or “our”) through our website (the “Website”) and any related services we provide (collectively, the “Services”). By accessing the Website, placing an order, or using our Services, you agree to these Terms.
We may update these Terms from time to time. Changes apply prospectively to purchases and Services after the “Last Updated” date. Your continued use of the Website or new purchases after updates constitutes acceptance of the revised Terms.
If you purchase through a trust or other entity, you represent you have authority to bind that entity to these Terms.
1. Order Acceptance and Cancellation
(a) General
Your order is an offer to buy products and/or Services under these Terms. All orders are subject to acceptance by Tuna Cans USA. We may refuse or cancel any order in our sole discretion, including after an order confirmation is issued, including for suspected fraud, pricing errors, inability to fulfill, compliance concerns, or if we reasonably believe the transaction may result in an unlawful transfer, possession, or use.
If we cancel an order before it ships (or before any regulated transfer steps occur), we will issue a refund to the original payment method when feasible.
(b) Customer Responsibility
You are solely responsible for ensuring that any item you purchase is legal to buy, possess, and use in your jurisdiction and for complying with all applicable laws and regulations.
2. NFA-Regulated Items (Suppressors)
(a) Transfers Through FFL/SOT
Suppressors and other items regulated under the National Firearms Act (“NFA Items”) must be transferred through a properly licensed Federal Firearms Licensee with Special Occupational Tax status (“FFL/SOT”). NFA Items cannot be shipped directly to you. By purchasing an NFA Item from us, you authorize us to ship/transfer the item to the FFL/SOT dealer you select, as required by law.
(b) Dealer Is Independent
Your selected dealer is an independent business and is not our agent, employee, partner, or representative. We are not responsible for dealer actions, delays, storage policies, transfer fees, hours, scheduling, or refusal to transfer.
(c) Shipping Timing
We typically ship NFA Items to your selected dealer within three (3) business days after order processing, subject to inventory, compliance, carrier constraints, and any information we reasonably need from you or your dealer.
(d) No Guaranteed Approval or Delivery Dates
ATF processing times, dealer timelines, and regulatory requirements vary. We do not control ATF processing, eForms availability, or dealer scheduling, and we cannot guarantee any approval or delivery date.
3. Pricing and Payment
(a) Pricing
All prices, discounts, promotions, and availability are subject to change without notice. The price charged is the price shown at checkout at the time the order is placed.
(b) Taxes and Fees
Prices do not include applicable sales tax, shipping, handling, or dealer transfer fees (if any). Dealer transfer fees are determined by the dealer and are your responsibility.
(c) Payment Authorization
You represent that payment information you provide is accurate and that you are authorized to use the payment method. Payment must be received prior to fulfillment.
(d) Errors
If a product is listed with an incorrect price due to a typographical or system error, we may correct the error and cancel or refuse any affected orders.
4. Shipping, Delivery, Title, and Risk of Loss
(a) Shipping
Non-NFA items (such as mounts, tools, apparel, and accessories) ship to the address you provide at checkout, subject to restrictions and carrier limitations. NFA Items ship to your selected FFL/SOT dealer.
(b) Title and Risk of Loss
To the fullest extent permitted by law, title and risk of loss pass to you when the product is tendered to the carrier for shipment (including shipment to your dealer). Shipping and delivery dates are estimates only and are not guaranteed.
5. Returns and Refunds
(a) NFA Items — All Sales Final
ALL SALES OF NFA ITEMS ARE FINAL. NO RETURNS. NO REFUNDS.
This includes, without limitation, suppressors and any other NFA-regulated items. You are responsible for confirming legal eligibility before purchase.
(b) Non-NFA Items (Mounts, Tools, Apparel, Accessories)
We accept returns of non-NFA items within fourteen (14) days of delivery only if:
- The item is unused and uninstalled (and apparel is unworn/unwashed)
- The item is returned in original packaging with all included parts and materials
- The return request is submitted within the return window
Return shipping costs are the customer’s responsibility unless the return is due to our error.
We do not accept returns for:
- Used, installed, modified, washed, or damaged items
- Items missing parts/accessories/packaging
- Clearance/final sale items (if marked as such)
- Gift cards or digital products (if offered)
(c) How to Request a Return
Email us at support@tuna-cans.com with:
- Your order number
- The item(s) you want to return
- The reason for return
Do not ship items back without authorization. Unauthorized returns may be refused.
(d) Refund Timing
Approved returns will be inspected upon receipt. If accepted, refunds are issued to the original payment method when feasible within [Insert: e.g., 5–10 business days] after inspection. Original shipping charges are non-refundable unless required by law.
(e) Defective or Incorrect Items
If your non-NFA item arrives defective or incorrect, contact us at support@tuna-cans.com within [Insert: e.g., 48 hours] of delivery and include photos of the item and packaging. We will work to resolve the issue.
6. Feedback and Reviews
Any reviews, comments, testimonials, suggestions, photos, videos, or other content you submit (“Feedback”) may be used by Tuna Cans USA for business purposes, including marketing, in a non-exclusive, royalty-free, worldwide manner, subject to applicable law.
7. No Legal Advice
Information provided on the Website or by our staff is for informational purposes only and does not constitute legal advice. We are not a law firm. You are responsible for obtaining legal guidance if needed.
8. Warranties and Disclaimers
Except as expressly stated in our written Warranty Policy (if applicable), products and Services are provided “AS IS” and “AS AVAILABLE.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Some jurisdictions do not allow certain disclaimers, so some provisions may not apply to you.
9. Limitation of Liability
To the fullest extent permitted by law, Tuna Cans USA will not be liable for any indirect, incidental, special, consequential, or punitive damages, lost profits, or loss of data arising out of or relating to any order, product, or Services.
Our total liability for any claim will not exceed the amount you paid to Tuna Cans USA for the product(s) giving rise to the claim.
10. No Resale or Export
Unless you have written authorization from us, you represent you are purchasing for personal use and not for resale or export. All purchases are intended for delivery within the United States.
11. Privacy
Our Privacy Policy governs the collection and processing of personal information associated with your use of the Website and purchases.
12. Force Majeure
We are not responsible for delays or failures due to events beyond our reasonable control, including acts of God, carrier delays, government actions, ATF/eForms outages, supply shortages, labor disruptions, or power/telecom interruptions.
13. Governing Law and Venue
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. To the extent any dispute is not subject to arbitration, you agree to venue in the state or federal courts located in Broward County, Florida.
14. Dispute Resolution and Binding Arbitration
(a) Agreement to Arbitrate; Class Action Waiver
YOU AND TUNA CANS USA AGREE THAT DISPUTES WILL BE RESOLVED BY FINAL AND BINDING ARBITRATION ON AN INDIVIDUAL BASIS. YOU WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION OR REPRESENTATIVE PROCEEDING.
(b) Scope
Any claim, dispute, or controversy arising out of or relating to these Terms, the Website, any purchase, or Services will be resolved by binding arbitration, except that either party may seek injunctive relief in court for claims involving misuse of intellectual property, fraud, or unauthorized access to systems.
(c) Rules and Administration
Arbitration will be administered by the American Arbitration Association (AAA) under its applicable consumer rules, as modified by these Terms. The Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement.
(d) Authority and Relief
The arbitrator has authority to resolve all disputes regarding the interpretation, applicability, or enforceability of this arbitration provision and may award any relief available in court.
(e) Severability
If any portion of this arbitration section is found unenforceable, the remainder will be enforced to the fullest extent permitted by law.
15. Assignment
You may not assign your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
16. No Waiver
Our failure to enforce any provision is not a waiver of our right to enforce it later.
17. No Third-Party Beneficiaries
These Terms do not create third-party beneficiary rights.
18. Notices
(a) To You
We may provide notices by email to the address you provide, by posting on the Website, or through other reasonable means. You are responsible for keeping your contact information current.

19. Severability
If any provision is invalid or unenforceable, the remaining provisions remain in full force and effect.
20. Entire Agreement
These Terms, together with our Privacy Policy and any posted policies referenced herein (including our Warranty, Shipping, and Return policies), constitute the entire agreement between you and Tuna Cans USA regarding purchases and Services.
21. SMS Terms
If you opt in to receive SMS messages from Tuna Cans USA, you agree to receive transactional and/or marketing texts at the number provided. Consent is not a condition of purchase. Message and data rates may apply. Message frequency varies.
